Information About Eviction Cases
The 89th Legislature passed major changes to Chapter 24 of the Texas Property Code effective January 1, 2026 that will impact all eviction cases filed on or after January 1, 2026. While we work to update our website with the new information, please visit the Texas Legislature Online website to read the changes in SB 38 and Chapter 24 of the Texas Property Code.
The Texas Supreme Court has also preliminarily approved amendments to Part V of the Texas Rules of Civil Procedure to account for the changes made in SB 38, also effective January 1, 2026 for all evictions cases filed on or after January 1, 2026. These rules are currently published for public comment through February 1, 2026. Visit the Texas Supreme Court’s website to read the proposed rule changes.
